Who qualifies for chapter 7 bankruptcy?

11 USC 109 (Federal law) determines who can file for chap 7, but generally here are the qualifications:

  1. Be a living person
  2. Have lived in the state where you want to file for at least 6 months (some exceptions apply)
  3. Make less than the amount listed in this chart here. (For example, Utah family of 3 needs to make less than $76,066 (subject to annual changes) gross

If a person makes more than that, it may still be possible to file for chapter 7, but generally folks will be required to file under Chapter 13.
